TRANSFORMATION OF THE STATE SOVEREIGNTY OF UKRAINE UNDER THE CONDITIONS OF ARMED AGGRESSION BY THE RUSSIAN FEDERATION

Abstract. For a long time, sovereignty was considered the highest link in the development of statehood and established interstate relations. At the same time, state sovereignty does not refer to the “static” (immutable) features of the state, which are the territory and the people, because due to certain internal or external factors and circumstances, state sovereignty can be weakened, undermined and even lost. Today, sovereignty formally continues to remain an important basis for international relations, but no longer reflects real control over the territory. State sovereignty is gradually replacing sovereignty. A number of examples of the increased influence of sovereignty concern partially recognized self-proclaimed quasi-states. The majority of quasi-state entities (all in the post-Soviet space) were formed as a result of separatism and the participation in this process of neighboring states interested in ethno-political disintegration and supporting ethno-political instability. The main role in the disintegration processes of the region is played by the Russian Federation, which recognizes and supports unrecognized republics, providing them with informational, political, financial, and military assistance. The system of crimes that encroach on the state sovereignty and territorial integrity of Ukraine is united around a single specific object of the crime, namely social relations that regulate and ensure the protection of the state sovereignty and territorial integrity of Ukraine. The characteristic features of these crimes are: 1) the state sovereignty and territorial integrity of Ukraine are defined as the object of a socially dangerous encroachment; 2) the presence of real threats to the state sovereignty and territorial integrity of Ukraine; 3) the behavior of criminals aimed at achieving a special goal – encroaching on the state sovereignty of Ukraine and destroying its territorial integrity; 4) deliberate nature of criminal manifestations. The world experience of combating crimes against state sovereignty and territorial integrity shows that in such areas as politics, international relations and the sphere of state security, influence only by force methods, not supported by an appropriate legal basis and not combined with socio-economic, socio-psychological, ideological and other measures, capable of causing only a short-term and sometimes the opposite effect.
