ORGANIZATIONAL AND LEGAL BASIS OF INTERPOL’S ACTIVITY IN UKRAINE

Abstract

The relevance of the study of the organizational and legal foundations of Interpol’s activities in Ukraine is due to the importance of the tasks and powers of the National Police of Ukraine in terms of its performance of the functions of the National Central Bureau of Interpol in the conditions of martial law in Ukraine and the fight against international crime. The International Criminal Police Organization – Interpol is an intergovernmental organization whose mission is to promote international police cooperation of its member countries. It has legal personality separate from the legal personality of member countries and is governed by international law. Interpol’s activities, in addition to the norms of international law, are also regulated by the norms of the national legislation of the member countries. According to Art. 2 of the Statute of Interpol, the goals of this organization are: 1) to ensure and support the widest mutual assistance between all criminal police agencies within the limits of the legislation of different countries and in the spirit of the Universal Declaration of Human Rights; 2) create and develop all institutions that can effectively contribute to the prevention and cessation of general criminal crimes. Interpol is prohibited from any intervention or activity of a political, military, religious or racial nature. According to the Law of Ukraine “On the National Police”, the National Police of Ukraine represents and ensures the fulfillment of Ukraine’s obligations in Interpol and acts as the National Central Bureau of Interpol; organizes the interaction of law enforcement and other state bodies of Ukraine with Interpol, the European Police Office (Europol), as well as competent bodies of other states on issues related to the sphere of activity of Interpol and Europol. The article contains a general description of the main activities of Interpol. It is noted that Interpol is prohibited from any intervention or activity of a political, military, religious or racial nature. Interpol cooperates with the governments of various countries at the highest level, but at the same time all its actions are politically neutral and are carried out within the framework of the national legislation of the member countries.
