DEVELOPMENT OF RESCUE ACTIVITIES AT SEA AND ENSURING THE SAFETY OF NAVIGATION

Abstract

Abstract. This scientific article deals with issues related to legal issues of maritime safety, which areclosely related to the implementation of international cooperation in this field and the establishment and useof standards and technical norms, the competence of the port state, coastal state and flag, rescue and search at sea,and the implementation of international law into national law. Navigation is also a very effective commercialactivity. Accidents and incidents at sea are the cause of human and property losses, as well as causing irreparabledamage to the environment. Therefore, in order to avoid such serious consequences, States whose flags are flownshould take various effective measures to promote the safety of navigation. Emergency and rescue activities are oneof the foundations of shipping safety. The most important international legal acts regulating the legal relationshipon rescue at sea are the International Convention on Search and Rescue at Sea 1979, and the Rescue Convention1989, which Ukraine ratified on 22.03.2017, the study of the provisions of these Conventions, mainly, and isthe subject of this publication. The analysis of the Ukrainian legislation, and also judicial practice is carried out. Thearticle highlights the effectiveness of the implementation of international law at the national level, and identifies the mandatory conditions for such implementation. Conclusions are given which determine the impossibilityof making positive changes to solve the problem of maritime safety and rescue at sea without the active participationand assistance of all states involved in the use of the oceans. The states are responsible for the list of measuresaimed at adopting a regulatory framework for determining the procedure for conducting rescue operations at sea,the organization of inspection and control bodies.
