Abstract

This scientific article is devoted to the actual problems of the role of the mass media in the conditions of martial law in relation to the opposition to the Russian Federation. The main conditions for the distribution of information with limited access are disclosed, the aspects of responsibility for violating the norms of the current legislation are investigated. The classification of information with limited access in accordance with the norms of the current legislation (ZU “On access to public information”) is characterized: confidential, secret and official. Their general characteristics and features of their publication in mass media are given. Restrictions on rights during martial law have been established. Methods and ways of punishment for mass media collaborators have been studied. The rules for publishing the search for missing servicemen were analyzed. The limits of what is allowed in the publications of photos with scenes of violence and destroyed infrastructure, as well as the use of photos with children with the permission of both parents and the legal permissibility of publishing such photos without their consent, in particular, are revealed. The concept of the cult of violence and cruelty has been studied, the main aspects of this definition have been established. The process of documenting consent to the processing of personal data of witnesses of war crimes is characterized. The list of necessary data contained in the consent to the processing of personal data was established and cases were indicated when the corresponding consent to the distribution of personal data may not be agreed with the subject (for reasons of economic well-being and human rights, in the interests of national security), the legislative framework was analyzed accordingly to this aspect. Innovations regarding safety guarantees for journalists are analyzed. The obligations of the mass media regarding the provision of journalists and other specialists with means intended for personal protection against damage by firearms and shrapnel wounds, as well as first-aid kits for the period of their business trip to the regions of hostilities or occupied territories of Ukraine, were studied, and the legislative consolidation of this aspect was studied. Obligations regarding the insurance of the above-mentioned journalists in case of certain damage to their health or life were also analyzed.
