PEOPLE'S WILL IN UKRAINE AND PROSPECTS OF DRAWING OF ELECTORAL EU LAW INTO NATIONAL LAW

Abstract

The article identifies the priority areas of state policy that have emerged in the field of popular will with the signing of the Association Agreement with the European Union, Ukraine has defined for itself the democratic guidelines of the European community, to which Ukrainian society must move. As is well known, the institution of democracy, which is decisive for the paradigm of constitutionalism in Ukraine, first of all, needs to be harmonized with European standards, especially in the field of suffrage. Currently, the issue of application of European legal standards in the electoral law of Ukraine is due to great legal and political intrigue among the political elites of Ukraine, as most Ukrainians see the legal practice of old Europe as a model of civilization and future development of Ukraine. The current issues of the implementation of European standards regulating the electoral process in the EU countries in the legislation of Ukraine are considered, and the forms and possibilities of such introduction for guaranteeing the constitutional and political rights of Ukrainian citizens and building democracy in the Ukrainian state are being studied. The article examines the legislation in the field of electoral and other political rights in the field of popular will. It is concluded that there are many gaps in the electoral legislation, internal conflicts and a significant gap from the law of European democracies. In addition, emphasis is placed on Ukraine's European integration in the development of constitutionalism, given the signing of the Agreement on Cooperation with the European Union and the state and legal traditions of Ukraine as the successor of Kievan Rus. As a result of the study, it is concluded that the European standards of suffrage should be implemented, taking into account the national peculiarities of the Ukrainian state, without direct imitation of texts, but with justification of historical and legal originality of the Ukrainian way of statehood. First of all, it is necessary to implement the so-called mandatory norms concerning the implementation of the principles of suffrage contained in universal international acts on human and civil rights and freedoms.
