HUMAN RIGHTS IN THE CONDITIONS OF DIGITAL TRANSFORMATION OF SOCIETY: THEORETICAL AND LEGAL ANALYSIS

Abstract

In this scientific article the theoretical and legal analysis of human rights in the conditions of digital transformation of society is carried out. The article considers that digital transformation is an objective process that causes changes in public life, which are associated, in particular, with digitalization, which should provide everyone with equal access to information, knowledge and services provided on the basis of information. communication and digital technologies. It is established that in the conditions of digital transformation human rights are undergoing changes. Particularly significant in this context is the rapid development of e-democracy; introduction of electronic document management; Internet connection; development of telecommunications; introduction of national electronic information resources; provision of electronic services in all spheres of public life; implementation of electronic identification; digitization of administrative services, etc. It is substantiated that the process of human rights transformation has significantly accelerated in the context of globalization of technology and leads to the release of the fifth generation of human rights, which are characterized by artificial intelligence and digital transformation of society. It is proved that ensuring human rights in the conditions of digital transformation requires legal, organizational, technical and material support, which necessitates the improvement of not only the activities of the state. Priority in this direction should be not only the activities of the state, but also the activities of other civil society actors, including the media, which, according to statistics, have the greatest impact on the formation of public perceptions of human rights, as stated – 45, 3% of respondents. A separate area of state activity with the participation of civil society institutions, private IT companies and providers should be the creation and implementation of a program to expand the technical capacity of the population to access the Internet and mobile communications in all territories of Ukraine, their acquisition of knowledge about their rights in the field of digital technologies, their guarantee systems and protection mechanisms.
