CONTROVERSIALITY OF MORAL AND LEGAL PRESCRIPTIONS DURING THE IMPLEMENTATION OF ANTI-CORRUPTION MEASURES

The article is devoted to an important and relevant topic – the characteristics of the essence of moral and legal prescriptions, as well as to find out the degree of controversy. The authors note that combating corruption is a complex and multifaceted task. Currently, Ukraine has a very powerful regulatory and legal framework for anticorruption, which is based on international anti-corruption standards. However, the expectations of international partners from Ukraine regarding the effectiveness of anti-corruption reforms cannot be justified. After all, Ukraine and most of its international partners are at completely different stages of the formation of statehood, development of legal consciousness and culture. It is emphasized that for the effectiveness of anti-corruption reforms in Ukraine, it is extremely important to change the attitude of citizens towards this phenomenon by eliminating tolerance and neutralizing the "positive" qualities of corruption. both moral and legal norms are types of social norms designed to regulate relations in society. At the same time, moral norms are a kind of basis that arose historically much earlier and are more established in the minds of citizens. And regardless of the lack of a "single morality" for everyone, it is still much more difficult to change, update or even shape a person's moral orientations than legal ones. After all, legal norms can always be armed with means of state coercion. Considering the above, for effective and rational introduction of certain norms, their compliance with moral ones is required. This will simplify law enforcement. Moral norms became the basis for legal norms, while their essential difference is that legal norms can be less "strict", because they allow relativity and discretion. Instead, moral norms are more imperative and are adjusted quite rarely. Unfortunately, the level of legal culture and legal awareness of the population in Ukraine is quite low. Therefore, citizens do not commit crimes because of respect for the law, but only because of elementary fear of punishment.
