PROTECTION OF RIGHTS IN THE SPHERE OF SOCIAL SECURITY OF JUDGES: AN OVERVIEW OF JUDICIAL PRACTICE

Abstract

The article is devoted to a review of judicial practice regarding the protection of the rights of judgesin the field of social security. It is determined that the position of a judge is extremely important for the system ofprotection of rights and freedoms in a democratic state, and the state should pay special attention to their socialsecurity, while the practice of protection of violated social security rights in court should be meticulously coveredin in the field of social security. It is noted that former judges often try to protect their own social rights in mattersof recalculating the monthly lifetime retention of a retired judge in court. It is stated that the prevalence of suchcases is confirmed by the exemplary decision of the Supreme Court in case № 620/1116/20. It is emphasizedthat the cornerstone conclusions on this case, which were made by the highest judicial body of Ukraine, werepreceded by no less topical decision of the Constitutional Court of Ukraine of 18.02.12020 № 2-r/2020. The studyalso examines in detail cases in courts of first instance, where former or current judges protect their own socialsecurity rights. It is also emphasized that the right of a retired judge to a pension or monthly lifetime allowanceis also a social guarantee for working judges, who must have confidence in their own future, which will pay forall the stress that accompanies judicial activity. As a result, the category of administrative cases where judgesdefend their own social rights is less numerous than cases involving, for example, internally displaced personsor persons affected by the Chernobyl disaster, but no less interesting in terms of legal conflicts that requireeffective solutions. In general, the results of judicial disputes with the authorities are positive for judges and not infrequently end up in full satisfaction of those claims that are put forward in connection with the violation ofsocial guarantees proclaimed by the state of Ukraine.
