LEGAL ENTITIES AS PARTS OF LAND`S SALE CONTRACT ON UKRAINIAN LANDS OF RUSSIAN EMPIRE

Abstract. The article shows that legal entities under Russian imperial law, which also applied to Ukrainianlands, could be parties to a contract of sale of real estate. It is established that the list of legal entities was given in the10th volume of the Complete Code of Laws of the Russian Empire, devoted to civil law, but some rules governingthe legal personality of legal entities were contained in the Trade and Credit Statutes. Therefore, a certain disorder ofthese norms was proved and it was found that in practice there were cases on the settlement of which the legislationdid not develop a clear position, so a certain role in clarifying the right to acquire, own and dispose of real estateplayed official explanations of the law carried out by Civil Department of the Government Senate. Although theofficial legal doctrine of Russian Empire did not regard legal practice as the sources of law, the official interpretationwas based on it in clarifying the legislation on the transfer of land by legal entities. It has been established that inthe Ukrainian lands of the Russian Empire, legal entities that could buy and sell land and other real estate werenot only business entities. Numerous estates of the corporation – nobles, peasants, corporations of citizens and theclergy – were engaged in the purchase and sale of land. Even after the liberal reforms of the 60's and 70's of theXIX century that situation hasn`t changed. Legal inequality of the population was dictated by the religious andnational diversity of the population of Ukrainian lands. The imperial policy of the state, aimed at strengthening theRussian and Orthodox elements in land tenure, was reflected in the restrictions to infidels and foreigners, and henceto the legal entities created by them to participate in land relations, up to the ban on land ownership. It was found that, despite numerous legal restrictions and obstacles, legal entities in the Ukrainian lands were active participantsin the process of land circulation, including its purchase and sale. Together with other factors, it contributed todemographic, economic and social changes in Ukraine of XIX century.
