Abstract

The article examines the main guarantees of the right to work for persons with disabilities, emphasizing the key aspects of equality, inclusion and respect for human dignity. Given the growing demands for social justice, special attention is paid to the analysis of international legal standards, such as the UN Convention on the Rights of Persons with Disabilities (CRPD), which lays the foundation for the social model of disability. The article emphasizes that the CRPD, in particular its Article 27, establishes progressive obligations for state parties in the field of employment, including the prohibition of discrimination, ensuring fair working conditions, providing access to vocational training and rehabilitation, promoting self-employment and adaptation of the work environment. Particular attention is paid to the relationship between the right to work and other fundamental human rights. The article reveals how non-compliance with the right to work negatively affects the realization of the right to a decent standard of living, education and social integration of persons with disabilities. The author argues that violations of the right to work create barriers that significantly impede access to economic and social opportunities for this group of people. The author analyzes how constitutions and special legislation of different countries prohibit discrimination in the field of labor of persons with disabilities. For example, the Constitution of Germany (Article 3), the Constitution of South Africa (Article 9), and the Rehabilitation Act of the United States (Section 504) provide legal mechanisms to combat discrimination on the basis of disability. In addition, positive examples from the European Union countries are considered, where the implementation of anti-discrimination directives has contributed to the creation of a favorable environment for the employment of persons with disabilities. The author analyzes the Ukrainian legislation on discrimination in the field of employment of persons with disabilities. It is emphasized that only a systematic approach, which includes legal, social and economic aspects, can ensure the full realization of the right to work of persons with disabilities.
