Abstract

Abstract. This article reveals the concept and features of the rights of persons with disabilities as a result of the war. It was noted that the national legislation of Ukraine does not contain a clear definition of the concept of «person with a disability as a result of the war». The definition of «person with a disability as a result of war» at the legislative level is assigned to the category of «war veterans». A person with a disability as a result of war is a natural person who has suffered a permanent physical, mental, intellectual or sensory impairment as a result of direct participation in military operations or exposure to wartime circumstances. Features of the category «persons with disabilities due to war» are: 1) variety of causes of disability. Disability may be caused by injuries, contusions, mutilations, diseases or mental injuries received during or as a result of hostilities; 2) inclusion of various population groups among persons who may become disabled as a result of the war. This category includes: military personnel, civilians and children who were affected by hostilities or directly participated in them; 3) the need for specialized medical and psychological assistance. Persons with disabilities as a result of the war need comprehensive medical, rehabilitation and psychological assistance to restore and maintain their health and quality of life; 4) social and economic vulnerability. This category of persons experiences significant social and economic difficulties associated with the loss of working capacity, the need for long-term treatment and rehabilitation, as well as possible resettlement or loss of housing; 5) the need for special legal protection and social support. Persons with war-related disabilities require special measures of legal protection and social support, including access to education, employment, social services and housing. Legislation must take into account their specific needs and ensure the realization of their rights on an equal basis with other citizens.
