ANALYSIS OF THE REGULATORY AND LEGAL PRINCIPLES OF THE ORGANIZATION AND FUNCTIONING OF THE VOLUNTARY UNITED TERRITORIAL COMMUNITY IN UKRAINE

Abstract

Abstract. The article determines that the Constitution of Ukraine plays a key role in guaranteeing the legal foundations of the organization and functioning of a voluntary united territorial community, and defines the basic principles of local self-government, establishes the powers of territorial communities and provides them with resources. The Constitution of Ukraine also guarantees the legality of the activities of local selfgovernment bodies and creates conditions for cooperation between communities. It was revealed that the European Charter of Local Self-Government is the international legal foundation of the right to local selfgovernment, which establishes basic standards for the organization and functioning of united territorial communities, guaranteeing their legitimacy. It is noted that the European Charter of Local Self-Government is a powerful tool for the development of united territorial communities in Ukraine, which brings the Ukrainian system of local self-government closer to European standards, promotes the European integration of Ukraine and the development of cross-border cooperation. It was determined that the regulatory and legal principles of the organization and functioning of a voluntary united territorial community in Ukraine arise as a result of complex administrative activities of state authorities and local self-government bodies, which include: legal acts (statutes, regulations, rules, instructions, etc.); individual acts and illegal acts (programs, recommendations); administrative contracts. It was revealed that the peculiarity of the regulatory and legal foundations of the organization and functioning of a voluntary united territorial community in Ukraine is their formation on: – the general idea of local self-government, which is established by international and constitutional norms; – specialization of the activities of local self-government bodies in Ukraine, which is determined by the laws and by-laws of Ukraine; – specific conditions for the functioning of a separate territorial community, which are established as a result of the internal rule-making activity of the territorial community (adoption of internal documents, rules, conclusion of contracts, etc.).
