Abstract

Abstract. The studied topic is relevant in the current conditions of sustainable development of crisis processes in the world, on the European continent and in individual states, in particular – in Ukraine. The problem of the studied issue lies in the imperfection of administrative procedures aimed at protecting the interests and human rights, and effectively preventing corruption risks, excessive burden on the administrative apparatus of the state, the formation of unnecessary bureaucratic complications that make it impossible, under certain conditions, to avoid violations of individual rights. The above indicates the emergence of a discriminatory component, in cases where the legal status of one particular person does not depend on his will, but does not contribute to the desired result in the administrative procedure for real estate, unlike another person who is in other conditions and is able to freely exercise his rights and legitimate interests. Often the consequence of such processes are different opportunities to have access to justice, which is an unacceptable violation of the fundamental rights and freedoms of man and citizen. The ways to solve the problem are the study of foreign experience, the implementation of effective norms and the improvement of legal regulation of administrative procedures, by simplifying and eliminating gaps and collisions of legislation. Thus, the international experience in the implementation of administrative procedures in the field of real estate is subject to study and comparison with the existing legal support of such procedures at the level of national legislation. It is important to explore ways of solving problems of a discriminatory nature, taking into account the fundamental rights and freedoms of man and citizen, in the context of modern realities and various legal, financial, moral and physical conditions of a person. As a result of scientific research, conclusions should be reached on the allocation of the central part of the regulatory regulation of administrative procedures in the field of real estate and the weaknesses of secondary legal norms that complicate or make impossible a particular procedure, as opposed to promoting a safer, faster, legitimate and effective implementation and achieving a specific legitimate result.
