SOCIAL AND LEGAL PROTECTION OF MILITARY PERSONNEL OF THE STATE BORDER GUARD SERVICE OF UKRAINE: CERTAIN ASPECTS OF REGULATORY AND LEGAL SUPPORT

Abstract. The article examines certain aspects of the regulatory and legal support for social and legal protection of military personnel of the State Border Guard Service of Ukraine, which determine the fundamental principles of state policy of Ukraine in this area. Through the prism of the Constitution of Ukraine provisions, the regulatory aspects of social and legal protection of military personnel have been considered, and constitutional and legal arsenal has been comprehended, which provides Ukrainian legislation in the regulated spectrum of rights and freedoms of military personnel at the State Border Guard Service of Ukraine. An analysis of the provisions of the Law of Ukraine “On Social and Legal Protection of Military Men and Members of Their Families” has been carried out regarding the system of social and legal protection, which is guaranteed to military men in the political, public, economic and social areas. It has been proven that social protection is carried out by the state within the right field, and legal protection of military personnel is within the social orientation. Emphasis is placed on the fact that, when exercising their general civil rights, military personnel must comply with certain requirements and restrictions that are determined by the specifics of their legal status as military personnel. It is established that social protection, which is guaranteed by the state for all citizens of Ukraine in accordance with Article 46 of the Constitution of Ukraine, differs from the social protection of military personnel, which is defined in the Law of Ukraine “On Social and Legal Protection of Military Men and Members of Their Families” in its content. It is emphasized that in contrast to the provision of Article 3 of the Constitution of Ukraine, which is aimed at the relationship by definition “from a person to the state”, military personnel are burdened with restrictions on the possibility of exercising certain general civil rights, in particular, with regard to the specifics of the exercise of economic, civil, and political rights and freedoms. The need for a unified interpretation and perception of the content of “legal protection” of military personnel, which should be interpreted by the Law of Ukraine “On Social and Legal Protection of Military Men and Members of Their Families”, the structure of which will then be consistent and logical, is argued.
