Abstract

Abstract. The scientific article is devoted to the analysis of the normative and legal provision of the right to biological parentage of military personnel and other persons, the prospects for the regulation of this right in Ukraine through the prism of the current demographic situation and the full-scale invasion of the Russian Federation into Ukraine. The author emphasizes the fact that the main risk of military service is the risk of death, and if a person used reproductive cell preservation programs for military personnel or previously underwent a treatment program and stored reproductive material in a cryobank, there may be a problem with posthumous reproduction, which is currently not prohibited. but it is not regulated by the current legislation of Ukraine. The article analyzes the foreign experience of implementing the procedure of posthumous reproduction, in particular, reveals the legal aspects of disposal of reproductive material in the event of a person’s death. Attention is focused on the fact that there is currently a steady trend towards the legalization of posthumous reproduction in legislative activity. For the proper legal regulation of posthumous reproduction in Ukraine, it is proposed to regulate: granting or prohibiting posthumous reproduction of reproductive material removed from a deceased person during his lifetime, and determining the possibility of removing reproductive material from a deceased person; establishing clear requirements for the use of posthumous reproduction, the procedure for granting consent, etc.; establishing the period of permissible postmortem storage and use of reproductive material and/or cryopreserved cells of a deceased person; settlement of inheritance rights of a child born through posthumous reproduction; establishment of paternity/maternity of a deceased person with respect to a child born as a result of posthumous reproduction; the possibility of using this method of assisted reproduction by foreigners on the territory of Ukraine and the admissibility of exporting reproductive material from the territory of Ukraine abroad, the possibility of using the method of posthumous reproduction by citizens of Ukraine abroad.
