STATE POLICY ON THE PREVENTION OF OFFENSES IN THE FIELD OF CONSTRUCTION IN UKRAINE

Abstract. It is common knowledge that state policy plays an extremely important role in public life. It is she who is called to timely identify the ripe problems of the development of society, analyze them, establish the causes of their occurrence, difficulties, contradictions and find ways to solve these problems. In the sphere of state policy, appropriate state-political decisions are made, appropriate tools are developed, and a mechanism for their implementation is created. The article emphasizes that the construction industry is one of the strategic sectors of the economy and has an important social significance, because it provides the basic needs of the population, including housing, infrastructure network, transport connections, and occupies one of the key places in the country’s economy in terms of development and capitalization rates, compared to its other segments. State policy is not only a purely managerial activity of state bodies or an activity that is a response to what requires a state reaction, but also a strategic activity, appearing as a complex socio-legal, political and economic phenomenon that: has a clear legal form, filled with concrete content; is objectified on the grounds and conditions determined by legislation; presupposes the existence of an administrative and legal mechanism for its formation and implementation in accordance with certain strategies and programs, as well as the urgent needs of society and the state. Critically analyzing various approaches of scientists to determining the essence of state policy, the author came to the conclusion that they can be divided into the following main groups of interpretive approaches: explaining the essence of state policy through the operational aspect of the manifestation of state policy (formal approach); explanation of the essence of state policy through the responsive aspect of the manifestation of state policy (content approach); explanation of the essence of state policy through the planning and strategic aspect of the manifestation of state policy (prognostic and strategic approach). In this regard, the state policy in the field of construction should include the following features: coherence – coordination of all policy components among themselves, forming one organizational whole, one system, the development of which determines it; hierarchy – state authorities make decisions, transfer them «vertically» for implementation according to the established hierarchy of powers; completeness – availability of a set of means for decision-making, their implementation, adjustment, attraction of necessary or additional resources, evaluation of implementation.
