LEGAL BASIS OF THE INFLUENCE OF POLITICAL PARTIES ON THE FUNCTIONING OF THE STATE MECHANISM

Abstract

Abstract. The article reveals the concept of a political party as a voluntary structured public formation thatoperates on a permanent basis and unites citizens on the basis of commonality of their political views, ideas, beliefsand in order to implement their political will, participates in the formation of public authorities through nominationin elections, development and implementation of state policy on the basis of the national program of societydevelopment. Such means of influencing political parties on the functioning of the state mechanism are distinguished asparticipation in the formation of public authorities through involvement in electoral processes and implementationof state policy through the participation of party representatives in the activities of public authorities.The peculiarities of the influence of political parties on the state mechanism through their parliamentaryactivity are analyzed. It is emphasized that the parties that have formed factions in the parliament have a numberof advantages over other parties, and this is not only state funding of their activities, but also additional access tothe media; guaranteed representation in election commissions in the next elections, etc. The ways of normativeregulation of the status of the parliamentary coalition and opposition by including the relevant provisions in the Rulesof Procedure of the Verkhovna Rada of Ukraine are proposed.The means of influencing political parties on the functioning of executive bodies are outlined, in particular,through the procedure of forming the composition of the Cabinet of Ministers of Ukraine. It was emphasized thatthe procedure for nominating members of the government by both the President of Ukraine and the Prime Ministerof Ukraine is too complicated and lays the groundwork for possible contradictions in the government. Accordingly,it is proposed that the candidacies of all members of the Cabinet of Ministers be submitted to the Parliament bythe Prime Minister of Ukraine. This will increase the responsibility of the party, which has a direct influence onthe formation of the government, for its subsequent activities.The special role of the Program of Activities of the Cabinet of Ministers of Ukraine for its further effectivework and the influence of political parties on the formation of the content and directions of implementation of sucha Program are pointed out.
