Abstract

The article is devoted to the execution of court decisions by the state in accordance with the law. The importance of effective execution of court decisions to ensure justice, restore violated rights and strengthen confidence in justice is considered. Effective execution of court decisions ensures the preservation of the rule of law and the development of a just society. The role of execution of court decisions in ensuring legality and legal responsibility is also defined. The responsibility of public and private executors who do not comply with court decisions on the part of competent authorities is considered. This scientific article examines the significance of challenging the decisions, actions or inaction of state and private executives in court as a form of judicial control over the execution of court decisions in administrative cases. It turns out that this practice contributes to ensuring the legal responsibility of executors and strengthening trust in the executive system as a whole. At the same time, the appeal of decisions gives the participants of enforcement proceedings the opportunity to protect their rights and interests, contributing to a fair and effective enforcement process. The form in which judicial control is carried out – the filing of a claim, which ensures an immediate reaction to the violation of the rights, freedoms and interests of the participants in the executive proceedings – is being studied. This mechanism guarantees quick and effective protection of rights and interests in accordance with legal procedures. The importance of consideration of the case in the administrative court as a mechanism for monitoring the correctness of executive actions and ensuring legal liability in case of violation of the rights, freedoms or interests of the participants in executive proceedings is analyzed. The article also examines the procedural aspects of appeals against court decisions in cases that fall under the specified guidelines. It is indicated that appeals can be submitted within ten days from the day of their announcement. In addition, it is emphasized that the appellate court considers the case within a ten-day period after the end of the term for filing an appeal with notification of the parties to the case.
