LEGAL CHARACTERISTICS OF THE SYSTEM OF PUBLIC RAIL TRANSPORT MANAGEMENT ENTITIES IN UKRAINE

Abstract

The purpose of the article is to characterize the system of entities managing public rail transport in Ukraine based on the analysis of the theoretical foundations of financial and administrative law, the norms of current legislation and the practice of the executive authorities. The relations of railway transport enterprises with local bodies of executive power, local self-government bodies are based on tax and contractual grounds in accordance with the current legislation of Ukraine. The competence of these bodies includes: control over the operation of suburban railway passenger transport and stations, approval of tariffs in suburban connections, approval of the issue of stopping points, closure of railway stations for passenger service, car crossings over railway tracks. Local executive authorities and local self-government bodies are entrusted with the organization of work on the improvement of station areas, the construction and arrangement of entrances to railway stations, providing them with telephone communication and transport connections with settlements near the location of the stations, prevention of offenses on railway transport . It was concluded that the system of public rail transport management entities in Ukraine is quite complex and extensive, which is formed at a complex coordination level, including entities with different legal personality, each of which is responsible for specific functions. The system of public rail transport management entities in Ukraine includes: 1) Cabinet of Ministers of Ukraine; 2) Ministry of Development of Communities, Territories and Infrastructure of Ukraine; 3) Private joint-stock company “Ukrzaliznytsia” (as the main operator of railway transport, which ensures the movement of trains, operation and development of railway infrastructure); 4) State Inspection of Ukraine for Land Transport Safety (Ukrtransinspektsia); 5) local bodies of executive power, bodies of local self-government; 6) additional entities providing a separate direction of railway infrastructure development (for example, the Ministry of Digital Transformation of Ukraine creates conditions for digitization of the provision of transport services, etc.).
