Abstract

The article is devoted to consideration of issues related to the activities of the ECtHR and its internal administration, the historical aspect of the formation of the ECtHR, issues of the application of ECtHR practice and the ECtHR’s interaction with Ukraine, prospects for the development of interaction. Special attention is paid to two topics: consideration of the criteria by which a case is accepted for consideration by the ECtHR, as well as the application of the practice of the ECtHR. It has been established that the number of complaints to the ECtHR is increasing every year. According to the statistics of the Ministry of Justice, last year the European Court of Human Rights had 59,800 cases against the States parties to the Convention, of which 8,850 cases were against Ukraine, which is 14.8% of the total number of appeals. Before that, the number of appeals from citizens of Ukraine was 12.9%. More than 5,000 appeals against Ukraine concern human rights violations in Crimea and the temporarily occupied Luhansk and Donetsk regions. The author comes to the conclusion that thanks to its powers and the authority of its judicial practice, the Court has actually turned into the highest guarantor of the observance of the rights and freedoms enshrined in the Convention. Considering the fact that the ECtHR carries out such a large volume of work, the court cannot physically cope with the volume of incoming complaints. In this regard, the most promising is the possibility of creating additional divisions for processing complaints, as well as increasing the number of ECtHR judges. No less promising is the creation of domestic committees for processing complaints to the ECHR, with the aim of pre-selection of inadmissible cases. There is also a need to develop Ukraine’s interaction with the ECHR in order to improve the state system of legislation and law enforcement in accordance with the standards of the Council of Europe.
