THE NATURE OF THE LEGAL STATUS OF THE STATE INSPECTION OF ARCHITECTURE AND URBAN PLANNING OF UKRAINE

The article describes the concept of legal status and an attempt is made to reveal the nature of the legal status of the State Inspection of Architecture and Urban Planning of Ukraine through the prism of its competence, rights and responsibilities. In particular the definition of the term “legal status of the State Inspection of Architecture and Urban Planning of Ukraine” is proposed as a system of rights, duties and responsibilities of this authority defined in legal norms and regulations with their inherent systematicity, which characterize its legal position and determine its place in the system of executive authorities . Also, the main rights granted to this body are given and the responsibility of officials defined by legislation is indicated. The rights include, among other things, the possibility of interaction with various legal entities and individuals, as well as receiving the necessary information and documents from them; use of information databases of authorities, the state government communication system and other technical means; to demand control from specified bodies; carry out claim-lawsuit work, apply to the court with lawsuits for the protection of one's rights and legal interests, etc. Particular attention is paid to the powers of this authority, which are proposed to be divided into four groups: with regard to indirect control and supervision, with direct control and supervision, with regard to holding controlled entities accountable, organizational. Finally, the key problems are analyzed in the activity of this inspection, related to the imperfection of the relevant legal framework are analyzed; lack of openness and transparency of the actions of authorities related to the field of construction, management of the urban cadastre; lack of interaction of the State Inspection of Architecture and Urban Planning of Ukraine with other authorities and the public; lack of real control by society, etc.
