PECULIARITIES OF CERTAIN WORKING CONDITIONS OF JOURNALISTS

Abstract

The author of the article has studied the legal regulation of certain working conditions of journalists, as well as proposals for improving the acts of the current legal legislation of Ukraine in this sphere. It has been established that the peculiarities of the legal regulation of the labor relations of journalists are fixed by special norms and determined by the specific features and conditions of journalistic activity provided in article 12 of the Law of Ukraine «On State Support of Mass Media and Social Protection of Journalists». The differentiation of the legal regulation of the labor relations of journalists on that points that has been specified appears in the establishment of additional guarantees and benefits by the norms of Section IV of this Law. The conclusion is justified, that the disadvantage of certain norms of Section IV of the Law of Ukraine «On State Support of Mass Media and Social Protection of Journalists» about peculiarities of journalists' labor relations is that these norms have not changed since the adoption of the Law of Ukraine «On State Support of Mass Media and Social protection of journalists» dated September 23, 1997 and do not take into account norms of some legislative acts adopted after this Law that has been entered into force. According to this, it is proposed to set out the first part of article 13 of the Law in the new version. The necessity of making changes to the second part of article 13 is argued in order to bring it into line with the acts of the current legislation of Ukraine. It is specified about expediency of the exclusion from article 13 of this Law the third part of it about journalists' vacations, because these norms are not part of the «Labor Protection» legal institute. It is proposed to addit Chapter IV of the Law with a separate article 13-1 «Working time and rest time of journalists». The necessity of proper use in practice of the mechanism of contractual regulation of specific features and conditions of journalistic practice on the basis of the system of collective agreements and collective contract, taking into account with the direct legislative prescription about this in a number of articles of the Law of Ukraine «On State Support of Mass Media and Social Protection of Journalists».
