STATUS AND PERSPECTIVES OF DEVELOPMENT OF UKRAINIAN LEGISLATION IN THE FIELD OF DIGITAL ECONOMY AND DIGITAL SOCIETY

Abstract

This article contains a general description of the system of legislation of Ukraine in the field of digital economy and digital society, highlights the problems of the system of legislation in the field of digital economy and digital society, analyzes the systematization of EU and UK legislation in the field of digitalization of economy and society, suggested ways to improve the legislation of Ukraine in the study area. Analysis of the legislation shows that today it is impossible to talk about creating a system of effective legal regulation of public relations in the field of digital economy and society. For a long time there has been a quantitative increase in legislation, fragmentarily covering various areas of regulated relations. Uncertainty of state policy in certain areas of public relations creates their divergent and contradictory regulation. The purpose of improving the legislation in the research area is to determine at the legislative level the legal, organizational, economic and financial conditions for the creation and development of the digital economy and digital society in Ukraine, as well as state regulation in this area. Legislation should contain modern provisions on the mechanisms for the creation and development of the digital economy and digital society, which are contained in the regulations of the UN, the International Telecommunication Union, directives and other regulations of the EU and other international organizations. The positive experience of legislative regulation of the creation and development of the digital economy and digital society at the level of national legislation of individual countries should also be taken into account. In the process of improving the legislation of Ukraine, modern foreign experience in codifying legislation in the field of creating a digital economy and digital society is important. Important codified acts in this area are the European Electronic Communications Code (EU Directive 2018/1972 of the European Parliament and of the Council of 11 December 2018) and the UK Digital Economy Act, adopted in 2017.
