Abstract

The article examines issues related to the status of the state within the framework of modern international law and modern approaches to its existence as a subject of international law. It can be stated that modern international law, moving away from the ethical concept, continues to consider the state as the main subject of international law. At the same time, it puts forward a number of requirements to the states, which, for example, relate to the impossibility and non-recognition of territorial changes that occurred as a result of annexations, nonrecognition of states created as a result of violations of the imperative norms of international law, and states are responsible for committed violations of the norms of international law, which can be committed both directly by its bodies and agents, and those committed under its control, and those for which the state assumes responsibility. According to the UN Charter, sovereign title to territory cannot be acquired by force. Moreover, in the modern practice of international law, the continuation of the state’s existence in the event of a loss of territory in the metauniverse may be quite appropriate, since the efficiency criteria for the status of a contagion state are no longer relevant. The main thing will be the continuation of its recognition by other states, the continuation of the validity of its rights and the fulfillment of its international legal obligations. The search for directions of state development in the modern period is one of the main issues of geopolitical discourse. The world community, taking into account the political, economic, environmental and other challenges of today, is trying to create a new model of organizing harmonious coexistence of society. Against the background of all those contradictions caused by the processes of globalization and glocalization, against the background of the crisis of the mechanisms for ensuring the international legal order, new tasks and challenges appear before the modern states. Moreover, right now the foundations are being laid for the formation of the newest form of political, economic and ideological organization of managing society, which, in our opinion, is a metastate.
