FEATURES OF THE LEGAL REGULATION OF LABOR OF SCIENTIFIC AND TEACHING EMPLOYEES OF INSTITUTIONS OF HIGHER EDUCATION IN THE CONDITIONS OF MARITAL STATE IN UKRAINE

Abstract

The article examines the peculiarities of the legal regulation of the work of scientific and pedagogical workers of higher education institutions under the conditions of martial law in Ukraine. The author's definition of the term scientific and pedagogical workers of higher education institutions is proposed. It has been established that the issue of the work of scientific and pedagogical employees of higher education institutions in Ukraine is regulated by normative legal acts of a general and special nature. It was determined that the peculiarities of the legal regulation of the work of scientific and pedagogical workers of higher education institutions in the conditions of martial law in Ukraine consist of a number of legislative changes adopted regarding the establishment of additional guarantees for employees of institutions, educational institutions, and scientific institutions, which provide for various possibilities. The system of bodies entrusted with the organization of the educational process in the conditions of martial law has been singled out, which include executive power bodies, military command bodies, military, military-civilian administrations, local self-government bodies, their representatives, officials, management bodies of educational institutions, educational institutions, scientific institutions, their founders, public associations, charitable organizations and individuals who carry out charitable (volunteer) activities. Defined that issues in the field of education and science, which are not settled under martial law, are resolved by the Ministry of Education and Science of Ukraine by issuing orders, the term of which does not exceed the term of the special period. A number of orders of institutions of higher education, which regulated the peculiarities of the internal organization of the educational process under martial law, were analyzed. It is emphasized that in modern conditions there is a need to pay attention to solving problematic issues related to the restoration of the personnel potential of educational institutions due to a significant outflow of competitive pedagogical and scientific-pedagogical workers abroad or to other regions of the country, proposed to resolve them by the way of introducing supporting programs for this category of workers.
