Abstract

On May 8, 2022, at the summit of the "Big Seven" countries, full support was expressed for Ukraine in its fight against Russian aggression. All seven countries have pledged to provide military aid to Ukraine, fight against Russian disinformation in the world, and the G7 will also help rebuild Ukraine. Accordingly, they undertook to gradually abandon dependence on Russian energy, in particular by gradually stopping or banning the import of Russian oil. Take steps to ban or otherwise prevent the provision of key services on which Russia depends, intensify the sanctions campaign against financial elites and family members. On May 9, 2022, the US President signed the law on lend-lease military weapons for Ukraine. The last time a similar procedure was used during the Second World War. Now he can become an important factor in the Russian-Ukrainian confrontation. It should be noted that overseas partners give Ukraine not only weapons and equipment, but also money for the purchase of other weapons. The decision on the transfer of weapons is made according to an accelerated procedure. By law, the President of the United States authorizes the government to provide assistance to the extent necessary. At the same time, the lend-lease program will be implemented not only by the USA, but also by key NATO allies. And these weapons will go beyond the current supply of anti-tank and light anti-aircraft missiles, including medium- and long-range air defense systems, mobile artillery and military drones, as well as food, fuel, medical equipment and more, so that Ukraine can sustain its fight. The issue of compensation for damages to Ukrainian citizens as a result of armed aggression still remains open. It is noted that for the effectiveness of compensation for damage caused by military aggression, each country must introduce into its national legislation a rule that the aggressor state is held liable for any damage caused to the property of the civilian population as a result of hostilities, regardless of the results of this war. In such cases, the property of the aggressor state and its related persons located on the territory of third countries can be used to compensate the injured state, its municipalities, private individuals and legal entities and their associations based on the decisions of the courts of the respective country . The introduction of such norms will greatly simplify the procedure for compensation for damages: the victims will not need to prove every single fact of violation of the laws and customs of war by the military personnel of the aggressor state, the absence of military necessity in their actions, and the cause-and-effect relationship between their actions and the damage caused. It will be enough for the victim to prove the fact of committing aggression, which is, in fact, prejudicial, and the fact of causing damage as a result of hostilities that were the result of this aggression. To date, a package of draft laws in this direction has been registered in Ukraine.
