APPLICATION OF THE STANDARDS OF INTERNATIONAL HUMANITARIAN LAW BY AUTHORATIES OF REGIONAL SYSTEMS FOR THE PROTECTION OF HUMAN RIGHTS

The article examines the application of the norms of international humanitarian law by the authorities of regional human rights protection systems. It was determined that ensuring peace and security, human rights on a global scale today has become particularly acute. It has been established that in the conditions of world globalisation processes, international legal mechanisms for the protection of human rights do not effectively perform their functions in the current system of international relations. Transformations of international human rights law and international humanitarian law determine the existence, along with universal standards in the field of human rights protection, development and functioning of regional ones: European, inter-American, African and Arab. The authorised institutions of regional human rights protection systems, to provide more specific protection to victims of internal armed conflicts, developed a number of arguments, creating grounds for the application of international humanitarian law as an independent source of obligations for member states of relevant treaties and conventions. The possible consequences of the denunciation of the European Convention on Human Rights by the Russian Federation were determined, in particular, the European Court of Human Rights stopping the proceedings of the vast majority of cases against the latter regarding its violation of the norms of international law, the failure of the defendant to comply with any decisions, and therefore the impossibility of bringing it to justice. The practice of consideration by courts of regional systems of complaints about violations of the rights of individuals in the context of armed conflicts has been analysed. It has been established that the specified authorities make decisions on bringing the offending state to justice only within the framework of the international treaty that created such a system.
