LEGAL REGULATION OF ENSURING THE RIGHTS OF SUBJECTS OF LEGAL RELATIONS IN THE FIELD OF CROSSBORDER SURROGATE MATERNITY

Abstract

The article draws attention to the fact that one of the types of assisted reproductive technologies is the method of surrogate motherhood, which, by the way, is popular in Ukraine among foreign citizens. This is a relatively new type of assisted reproductive technology, which raises a number of ethical issues that require not just a statement, but a clear legal solution. At the same time, the legal regulation of surrogate motherhood, including with the participation of foreign elements, in our country is not sufficiently regulated, as a result of which there is a potential threat of violation of the rights of each of the subjects of such legal relations (including the weakest party – the child born surrogate mother). Indeed, in general, the relevant legal relations are regulated in a fragmentary way – different sides of such legal relations are regulated by different regulatory and legal acts. The author paid attention to the study of the current state of legal regulation of legal relations in the field of cross-border surrogate motherhood, as well as the existing risks for ensuring the rights of the subjects of the relevant legal relations. It was established that today the legal regulation of ensuring the rights of the subjects of legal relations in the field of cross-border surrogacy requires to be better In particular, it is proposed to establish requirements for mandatory notarization of contracts on surrogate motherhood, as well as to set requirements for the age and health status of potential parents. Attention was also drawn to the fact that conflict regulation of relations in the field of cross-border surrogacy leads to the fact that sometimes foreigners have to turn to Ukrainian courts to protect their rights in the reproductive field. As a result, foreigners whose countries have established a special procedure for registering paternity for children born through surrogate motherhood abroad have to turn to Ukrainian courts, which mostly satisfy the demands of the applicants, helping them to exercise their reproductive rights.
