FOREIGN EXPERIENCE OF HUMAN RIGHTS IN THE FIELD OF NATIONAL SECURITY

Abstract. Undoubtedly, the implementation of the task of protecting human rights and respecting agreements depends primarily on the level of the country’s achievements and the mechanisms that exist at the national level. Existing national laws, policy decisions, procedural rules and mechanisms are key factors for the realization of human rights in every country. It is therefore important that human rights become part of national constitutional and legal systems, that professional lawyers are able to apply human rights standards in practice, and that human rights violations are condemned and sanctioned. National standards have a more direct impact, and national procedural rules are more accessible than regional and international ones. The purpose of the research is to conduct a comprehensive analysis of the theoretical and legal framework and foreign experience of human rights in the field of national security. The author concludes that the system of human rights in the areas of national security has its components, including: protection of national sovereignty and territorial integrity; ensuring the protection of human rights and freedoms; creating conditions for political and economic independence; ensuring public order; fight against crime, etc. It is obvious that all these actions are carried out by authorized bodies, which in accordance with their powers implement various national plans, resolutions, directives, international treaties and norms of domestic law. It should be noted that the main body of national security is the armed forces of different countries and all government agencies. All of them have the main task assigned to them by the state - to ensure a high degree of protection of national interests, and in this context - to create appropriate conditions for the stable development of each individual, society and country. It should be emphasized that the condition for the effectiveness of this policy is to give priority to the protection of human rights and freedoms in a non-violent manner.
