LEGAL STATUS OF FOREIGN DIPLOMATIC MISSIONS AS SUBJECTS OF STATE MANAGEMENT OF FOREIGN ECONOMIC ACTIVITY

Abstract

The article presents a general theoretical analysis of the system of public administration in the field of foreign economic activity, analyzes the legal status, tasks and functions of the Ministry of Foreign Affairs of Ukraine and foreign diplomatic missions in the field of foreign economic activity. Ministries and other central executive bodies of Ukraine carry out public administration in the relevant areas (branches) of public administration. They are appointed, single, permanent, higher bodies of functional, sectoral and intersectoral competence in the system of executive bodies, subordinated to the Cabinet of Ministers of Ukraine, whose jurisdiction extends to the entire territory of the state, performing law-making and law enforcement functions. The peculiarity of public administration of foreign economic activity in Ukraine is that the functions of its implementation are distributed among a number of central executive bodies of both functional, sectoral and intersectoral competence. This is due to the complex intersectoral nature of such an object of public administration as foreign economic activity. The Ministry of Foreign Affairs of Ukraine belongs to the central executive bodies of functional competence, the functions of which include the state management of foreign economic activity in Ukraine. It is the main body in the system of central executive bodies, which ensures the formation and implementation of state policy in the field of foreign relations. The main tasks of the Ministry of Foreign Affairs of Ukraine, among others, include participation in ensuring, within the powers provided by law, the implementation of state foreign economic policy, the policy of integration of the national economy into the world economic system and other tasks. The Ministry of Foreign Affairs of Ukraine manages the bodies of the diplomatic service of Ukraine. The status, system, tasks and functions of foreign diplomatic missions of Ukraine are determined by the Law of Ukraine «On Diplomatic Service» of 07.06.2018 № 2449-VIII.
