OBJECT OF CRIMINAL OFFENSES COMMITTED BY JUVENILES IN THE FIELD OF ILLEGAL TRAFFICKING IN DRUGS, PSYCHOTROPIC SUBSTANCES AND SUBSTANCES

Abstract

The article contains the analysis of scientific research on the problems of determination the object ofcriminal offenses committed by minors in the field of illicit trafficking in narcotic drugs, psychotropic substances,their analogues and precursors. The author pays attention to the debatable issues of defining the object of criminaloffense, which are relevant in the theory of criminal law of Ukraine. What is more, it is pointed out that the valueconcept of the object of criminal offense is the most optimal and allows to model the object of crimes againstpublic health fully.The scientific article analyzes the problems of determination the generic, specific and direct object of criminaloffenses in the field of illicit trafficking in narcotic drugs, psychotropic substances, their analogues and precursors.It is noted that the definition of the direct object of these criminal offenses, which are committed with theinvolvement of a minor, have its own specifics, as it relates to the criminal protection of the rights and legitimateinterests of minors.It is emphasized that the terms “personal health” and “public health” should be distinguished. The basis of sucha distinction is based not only on quantitative indicators, but on the content. Thus, the peculiarity of the conceptof “population health” is that it is based not only on medical characteristics, but also on its social components toa greater extent. It is noted that the main direct object of the criminal offenses committed by minors in the field of trafficking innarcotic drugs, psychotropic substances, their analogues and precursors, is public health, which is defined as a setof social relations that provide a certain degree of physical, mental and psychological well-being of an indefinitenumber of people, regulated by law. In addition, it is necessary to highlight the additional direct object, which insome qualified (especially qualified) warehouses is mandatory. It includes the interests of minors, the conditions ofnormal development and proper moral education of minors, public order, etc.
