‘THE LAW OF ANNEXED TERRITORY’ IN THE MODERN CONCEPT OF INTERNATIONAL LAW

This article examines the international legal norms that prohibit «the law of annexed territory» are fundamental category for modern International Law and Municipal and Property law, whichs are inherent in the Anglo-Saxon legal family. This law as a classical norm from the Ancient Roman Republic (I century BC) is the basis of three options for actions (activities) that have been central to the guidelines for their choice by the relevant subjects of law: (1) to settle title to territory as the basis for establishing state authority within territorial communities, municipalities; (2) to regulate the use of force across established state borders and boundaries of territorial communities (municipalities); and (3) to provide subjects with the right along the lines of established borders or administrative territorial boundaries to determine their own destiny and space for power on their own or collectively. The prohibition of forcible annexation is an integral part of each of these processes, and their combination could have a transformative impact on the legal system as a whole.However, the significance of this issue is often overlooked or misinterpreted. Furthermore, analysts in this field have largely failed to recognize that modern states are engaged in a broader struggle for the future world order and risk the erosion of contemporary international relations.In this article the authors formulate their own definition of «annexation» and present conclusions regarding the role, function, and prerequisites for further consideration of the «law of annexed territory» within the framework of modern International Law, while also highlighting specific legal conflicts related to this issue.
