PECULIARITIES OF THE LEGAL STATUS OF SUBJECTS OF ADMINISTRATIVE AND LEGAL SUPPORT FOR COMMUNITY DEVELOPMENT

Abstract

The relevance of the article lies in the fact that in the administrative and legal mechanism of community development, in the conditions of digital transformation, subjects act as a key functional element that ensures the implementation of all other components of this mechanism. It is through their activities that the practical implementation of administrative law norms, the implementation of management decisions and the achievement of strategic goals of state policy in the field of regional development and digitalization takes place. The effectiveness of digital transformations at the level of territorial communities, as well as the level of accessibility and quality of public services, directly depend on the effectiveness of the functioning of subjects. The article, based on the analysis of scientific views of scientists, clarifies the content and reveals the meaning of administrative and legal status, and also highlights the elements of this category. The administrative and legal status of subjects of power that ensure the development of territorial communities, including within the framework of informatization, is characterized. The competence and powers of the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine, the Ministry of Community and Territorial Development of Ukraine, the Ministry of Digital Transformation of Ukraine, local state administrations and local self-government bodies as subjects of community development are disclosed. It is concluded that in the conditions of domestic realities, the system of subjects of administrative and legal development of territorial communities is made up of the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine, the Ministry of Development of Communities and Territories of Ukraine, the Ministry of Digital Transformation of Ukraine, local state administrations and local self-government bodies (rural, settlement, city councils and their executive bodies). Analysis of their legal status gives grounds to state the presence of an optimal and effective institutional structure that ensures the consistency of the implementation of the national policy of regional development at the national and local levels. All the subjects presented are endowed with the necessary set of powers to carry out full-fledged reforms and transformations of the life of territorial communities. As a drawback, it is worth noting the lack of regulatory regulation of the competence and powers of local self-government bodies and local state administrations in terms of digitalization of regions. Current legislative acts do not adequately address these issues, which needs to be corrected, because digital transformation is one of the most important and relevant components of modern regional development, which is within the scope of responsibility of these public authorities.
