NATIONAL SECURITY AND THE STATE AS OBJECTS OF CRIMINAL LAW PROTECTION

The article analyzes, including in historical retrospect, the concepts of national security and the state as objects of criminal law protection. It is stated that domestic criminal legislation, despite the use of the general term «state crimes», traditionally differentiated between state security, that is, the state of protection of state sovereignty, territorial integrity, inviolability of state borders and defense capability, which ensures the very existence of a sovereign and independent state, and state security, as the state of protection of the vital interests of the state, which ensures the authority and normal functioning of its institutions. The validity of the use of the concept of the foundations of national security in the current Criminal Code of Ukraine is emphasized. It is argued that this concept should be limited to state security (security of defense capability, state sovereignty, territorial integrity, inviolability of state borders) and the security of the constitutional democratic system (security of national sovereignty). It is argued that state security, as a state of protection of the vital interests of the state that ensure its normal functioning (and not the possibility of existence and self-preservation), is not a component of the foundations of national security and should be considered as an independent object of criminal law protection. Attention is drawn to the fact that the return to the Criminal Code of Ukraine of such an object as the state, in the conditions of the separation of national security (this is the idea embodied by the developers of the draft of the new Criminal Code) will significantly complicate, if not completely make impossible, the solution of the problem of distinguishing encroachments on national security and the state. It is concluded that to designate the vital interests that ensure the normal functioning of the state and its institutions, it is advisable to use the category of “state security”.
