PRINCIPLES OF ADMINISTRATIVE PROCEDURE IN THE LEGISLATION OF UKRAINE AND ISSUES OF THEIR PRACTICAL APPLICATION

The article examines the place and significance of the principles of administrative procedure in the activities of public administration in Ukraine. The role of administrative procedure as a legal form for the exercise of powers by public administration entities in relations with individuals and legal entities is revealed. The provisions of the Law of Ukraine “On Administrative Procedure” that establish the principles of conducting administrative procedures are analyzed, and their importance for ensuring legality, reasonableness, and timeliness in the adoption of administrative acts is determined. The article substantiates that the said Law contains general norms of law applicable to all types of administrative cases, while sectoral and special legislation establishes specific features of administrative procedures in particular areas of public-law relations. An analysis of normative legal acts regulating administrative-procedural activity is carried out, and general, sectoral, and special levels of legal regulation are identified. The relationship between the general principles of administrative procedure and special norms applied in registration, permit, and licensing procedures is demonstrated. Particular attention is paid to the level of awareness of civil servants and officials of local selfgovernment bodies regarding the principles of administrative procedure. Based on the results of sociological surveys conducted in 2024–2025, it is established that the principles most firmly assimilated are those long applied in law enforcement practice, whereas the principles introduced by the Law of Ukraine “On Administrative Procedure” require further clarification. The article concludes that systematic training and an increased level of legal awareness are necessary conditions for the proper application of the principles of administrative procedure and for ensuring effective protection of the rights of individuals in relations with public administration
