PROBLEMS OF IMPLEMENTING ADMINISTRATIVE PROCEDURES FOR MAINTAINING THE REGISTER OF OWNERSHIP RIGHTS TO REAL ESTATE UNDER MARTIAL STATE CONDITIONS

Abstract

The scientific work is devoted to a comprehensive study of the problems of implementing administrative procedures in the field of maintaining a register of property rights to real estate under the legal regime of martial law. The peculiarities of the functioning of the system of state registration of property rights under special legal restrictions caused by security risks, restrictions on access to state electronic resources, violation of the territorial integrity of the information infrastructure and the relocation of subjects of legal relations are analyzed. The paper examines the transformation of the administrative and legal status of subjects of state registration, the specifics of the exercise of their discretionary powers, as well as changes in procedural algorithms for accessing registers and performing registration actions. Key factors affecting the stability and continuity of the registration system are identified, including cyber threats, regulatory conflicts, gaps in legal regulation, technical limitations, and complications in verifying title documents. The existence of increased risks of violation of the principles of legal certainty, reliability of registered information and guarantees of protection of property rights, which are manifested in the possibility of double registration, abuse, loss or distortion of data, is substantiated. Based on the generalization of the regulatory framework and the practice of its application, proposals are formulated to improve administrative procedures, unify mechanisms for confirming rights to real estate, strengthen information security and increase the efficiency of interdepartmental interaction under martial law
