THE ROLE OF THE COUNCIL OF EUROPE IN ENSURING COMPENSATION FOR UKRAINE FOR DAMAGES CAUSED BY RUSSIAN AGGRESSION

The article examines the role and contribution of the Council of Europe in shaping an international compensation mechanism for damages caused to Ukraine by the armed aggression of the Russian Federation.The purpose of the study is to identify the legal and institutional instruments through which the Council of Europe facilitates the transition from political declarations to practical decisions in the field of reparations.It is demonstrated that after February 24, 2022, the Council of Europe adopted a clear stance on holding the aggressor state accountable and emerged as a leader in launching relevant mechanisms, particularly in the area of compensation for war damages. The first tangible outcome was the establishment, under its auspices, of the Register of Damage for Ukraine (as the initial element of the future international compensation mechanism), which began accepting claims in the spring of 2024. It is argued that the institutional model of the Council of Europe–through the Enlarged Partial Agreement–ensures openness to the accession of third states and provides the mechanism with legal legitimacy, while also laying the groundwork for subsequent stages: the Compensation (Claims) Commission and the Compensation Fund, as well as coordination with the future Special Tribunal for the Crime of Aggression (regarding the transfer of confiscated assets of convicted persons to the compensation mechanism). The article highlights the systemic role of the Council of Europe as an institutional platform capable of filling the efficiency gap of universal international organizations. It concludes that, despite the length of the process and implementation challenges (sources of funding, coordination with national confiscation regimes), the chosen model creates a realistic framework for ensuring justice and restoring the rights of victims, thereby strengthening confidence in the effectiveness of international law.
