THE SPECIFICS OF THE APPOINTMENT OF FORENSIC EXAMINATIONS IN THE INVESTIGATION OF WAR PROPAGANDA

The article is devoted to a comprehensive study of the issues of appointing and conducting forensic examinations in criminal proceedings concerning war propaganda. It is substantiated that the use of special knowledge in this category of criminal offenses plays a central role in the development of a separate methodology for investigating war propaganda, since it ensures confirmation of the fact of committing a criminal offense, establishment of its circumstances, and identification of the methods of preparing and implementing unlawful behavior. Taking into account the specifics of war propaganda, the timely appointment and conduct of forensic examinations is a key condition for effective investigation.Based on the analysis of judicial and investigative practice, it has been proven that the most common examinations in the investigation of war propaganda are linguistic examinations (semantic-textual and authorship analysis), computer-technical examinations, video and audio recording examinations, and, if necessary, comprehensive psychological and linguistic examinations. Particular attention is focused on the conduct of semantic-textual examination aimed at establishing the presence in messages of signs of public calls for aggressive war or armed conflict, as well as on the problems of studying creolized texts, where the combination of verbal and non-verbal components significantly enhances propagandistic influence. The conclusions emphasize the need to develop a structural element of the methodology for investigating war propaganda related to determining the typical forensic examinations that should be appointed in this category of criminal offenses. Implementation of this approach, combined with a situational approach, will make it possible to take into account specific investigative situations, correctly determine the list of necessary forensic examinations, and formulate appropriate questions for experts. This, in turn, will contribute to improving the entire process of pre-trial investigation of war propaganda, enhancing the effectiveness of the investigator’s interaction with persons possessing special knowledge, and ensuring proper evidence in criminal proceedings of this category.
