SOCIO-ECONOMIC FACTORS OF PIRACY AND LEGAL MECHANISMS TO COUNTERACTION

The article examines the socio-economic factors of maritime piracy and the legal mechanisms for its prevention in both international and national contexts. Piracy is considered as a multidimensional phenomenon that combines economic, social, legal, and security aspects. It is shown that poverty, unemployment, unequal access to resources, degradation of marine ecosystems, and the “resource curse” create a favorable environment for the criminalization of coastal communities. The study highlights the growing importance of hybrid piracy models that combine traditional attacks with cyber tools, such as GPS spoofing and AIS manipulation. In the legal dimension, key international instruments are analyzed ‒ the 1982 United Nations Convention on the Law of the Sea (UNCLOS), the 1988 SUA Convention, as well as recommendations of the International Maritime Organization (IMO) and Best Management Practices (BMP). The article emphasizes the challenges of jurisdiction and prosecution of piracy-related crimes, which are complicated by inconsistencies in national legislation and insufficient international coordination. Special attention is paid to the Ukrainian context, where the main threats in the Black Sea are military-political in nature, but global piracy trends significantly affect insurance costs, freight rates, crew safety, and the personnel policy of shipping companies. The proposed directions of state policy include the implementation of IMO and BMP recommendations into national safety standards, strengthening procedural mechanisms of criminal prosecution, developing training programs for crews and maritime security managers, expanding participation in international monitoring and coordination centers, enhancing cooperation with relevant international organizations, and improving the cyber resilience of port and vessel infrastructure. The findings demonstrate that effective counter-piracy measures require the integration of socio-economic and legal strategies.
