THE CONCEPT OF A CUSTOMS REPRESENTATIVE OFFICE IN UKRAINE IN THE CONTEXT OF EUROPEAN INTEGRATION STANDARDS

The article examines the theoretical and practical challenges of developing administrative and legal principles for the establishment of customs representation in the context of Ukraine’s European integration processes and the digitalization of customs procedures. The introduction of a new concept of customs representation in Ukraine from 2024 corresponds to the approach of the EU customs law. This provides for the introduction of a clear distinction between direct and indirect customs representation to improve state and business control in legal relations with customs brokers and to avoid gaps in legislation regarding responsibility for declaring goods. Under this approach, a direct representative acts on behalf of the enterprise, and responsibility to customs authorities remains with the enterprise, while an indirect representative acts on its own behalf, assuming responsibility together with the subjects of foreign economic activity. A unified system of criteria and conditions for all customs authorizations has been introduced. The object and subject of the activity of customs intermediaries have been disclosed. The separate components of the administrative and legal status of customs brokers as customs representatives are analyzed. It is indicated that customs brokers must meet certain criteria, including compliance with legal norms, the absence of criminal convictions, and must also appoint an employee responsible for interaction with customs authorities and compliance with authorization conditions. It is determined that customs representation is the performance by a customs representative of actions and customs formalities determined by the customs authority in the interests of the person he represents. It was established that in order to confirm his powers and the type of representation, the customs representative must provide the customs authorities with documents (contract) confirming his powers and meeting the authorization criteria.
