NATIONAL COMMISSION FOR STATE REGULATION OF ENERGY AND PUBLIC UTILITIES – SUBJECT OF ADMINISTRATIVE AND LEGAL REGULATION OF RENEWABLE ENERGY

The study of relevant, but still little-studied in national legal science, issues related to the category of «renewable energy» is of not only theoretical, but also practical interest. This article examines the role and significance for the field of renewable energy of such an entity as the National Commission for State Regulation of Energy and Public Utilities (abbreviated as NKREKP).It was found that the transition of the national energy sector to renewables has significant qualitative advantages, thanks to the use of traditional energy sources: preservation of non-renewable fuel sources; slowing down climate change and reducing the number of adverse natural phenomena associated with it; increasing human life expectancy; opening new enterprises and creating new jobs. It has been established that the consolidation of the legal status of the NKREKP corresponds to the modern approach to determining the legal status of such a European state regulatory body in the energy and service sectors: 1) prerequisites have been created for stable state regulation of the impact on the activities of natural monopolies in the energy sector, including in the field of renewable energy; 2) Ukraine’s fulfillment of its international obligations to the Energy Community. It is proposed to divide all functions and powers of the NKREKP into two main groups: general – that is, those that concern all entities in the energy and utilities sector, and special – that is, those that determine the role of this commission in certain areas/spheres of energy. In the field of renewable energy, the powers of the NKREKP relate to: ensuring the functioning of the register of guarantees of origin of electricity generated from renewable energy sources and issuing guarantees of origin of electricity generated from renewable energy sources, and integrating the register of guarantees of origin of electricity generated from renewable energy sources with the registers of the countries of the Energy Community, the European Union and the Organization for Economic Cooperation and Development.
