ASSESSMENT OF THE EFFECTIVENESS OF LEGAL MECHANISMS FOR AVIATION TRAFFIC RESTORATION AND SAFETY IN THE CONTEXT OF INTERNATIONAL ARMED CONFLICTS

Abstract

In the context of modern international armed conflicts, the issue of aviation traffic restoration and safety is of particular importance. The destruction of airport infrastructure, threats to civil aviation, and the need for the rapid recovery of air transport require effective legal mechanisms. This article provides a comprehensive analysis of international and national legal instruments aimed at regulating aviation security in crisis situations, as well as their effectiveness in the post-conflict recovery of aviation operations.The study examines international legal norms, particularly the Chicago Convention on International Civil Aviation and ICAO regulations, which govern flight safety, the protection of aviation infrastructure, and the rights of passengers. Special attention is given to the role of international organizations and mechanisms of state cooperation in restoring the aviation sector after military conflicts. The article identifies key challenges faced by countries experiencing armed conflicts or seeking to rebuild their aviation industry, including issues of funding, legal regulation of reconstruction efforts, and international cooperation.National legal approaches to ensuring flight safety in crisis conditions are also explored, along with mechanisms for adapting national legislation to international standards. Case studies of countries that have successfully restored their aviation infrastructure after armed conflicts are analyzed to identify the most effective legal solutions and instruments.The research findings indicate that the effective restoration of aviation traffic requires a comprehensive approach, incorporating both national and international legal frameworks. The study highlights the need to improve existing legal norms to facilitate the rapid and safe recovery of airspace operations, as well as the importance of international support in rebuilding the aviation industry.
