CRIMINOLOGICAL APPROACHES TO GROUP DISINTERESTED VIOLENT CRIME OF CHILDREN AND ITS FEATURES

The article examines violent disinterested crime of children and establishes that it is predominantly group in nature, because it is within the group that children, as a rule, commit the most serious crimes such as murders, bodily harm, torture, hooliganism. The characteristic features of group violent crimes committed by children are the social danger of the act and the violent nature of the crime. The degree of social danger is determined by the entire set of features of the crime: the value of the benefits that the crime encroaches on, namely, the harmfulness of the consequences that occur due to the commission of the crime, the method and motive of the act, the form and degree of guilt. Thus, it is proposed to understand group disinterested violent crime of children as a set of unlawful, guilty, socially dangerous acts that are disinterested, but violent in nature, committed as part of a group by persons under the age of 18 and encroach on inalienable human rights, in particular life and health, honor and dignity, as well as moral and cultural values.A criminal-legal characteristic of group disinterested violent crime of children is provided and it is found that this category of crimes includes: intentional murder; all types of intentional bodily harm; torture and partly hooliganism, which form an independent block of criminal unlawful violent acts in criminological terms. It is established that the system of regulatory legal acts that determine the existence of the institute of group disinterested violent crime of children is imperfect, since the current legislation of Ukraine contains many contradictions and gaps. Analyzing the norms that regulate liability for crimes committed by children in complicity, the author concluded that there is a problem of formulating the concept of group criminal offense in the national criminal legislation. Currently, in criminal proceedings, problems arise when bringing persons to justice for group murder (clause 12, part 2, article 115 of the Criminal Code of Ukraine). Ways to solve the outlined problem are proposed.
