ELECTRONIC SERVICES: MODELS OF LEGAL REGULATION

Abstract

This scientific article is devoted to the current problems of providing electronic services provided by state authorities and local self-government bodies on the basis of an application submitted by an individual or legal entity. It is emphasized that the development of information technologies has made it possible to introduce information and communication systems into the activities of public authorities, the use of which has made it possible for citizens to receive various types of electronic services. In order to study the legal regulation of relations in the provision of electronic services, an analysis of the works of scientists who studied the problematic issues of providing electronic services was carried out. A number of domestic regulatory legal acts related to the legal development of relations in the field of electronic service provision were analyzed, among which it is worth noting the Laws of Ukraine: “On the Peculiarities of Providing Public (Electronic Public) Services”, “On Electronic Identification and Electronic Trust Services”, “On Electronic Documents and Electronic Document Management”, “On Electronic Communications”, “On Administrative Services”. The subordinate legal acts that initiated the formation of electronic services were also analyzed. First of all, this concerns the orders and resolutions of the Cabinet of Ministers of Ukraine on the development of the system of provision of administrative services by executive bodies, issues of preparation of draft legislative acts in electronic form, development of the system of electronic services, etc. It has been established that using information and communication systems, the provision of electronic services can be carried out not only by state authorities and local governments, other state-authorized enterprises and organizations, but also by judicial bodies. Attention is drawn to the possibility of obtaining various types of electronic services available on the website of the Cabinet of Ministers of Ukraine, as well as existing problems in providing electronic services to citizens living in rural areas, who are currently unable to receive all types of electronic services specified on the website of the Cabinet of Ministers of Ukraine. It is concluded that depending on the sectoral focus, there are different models of legal regulation of the provision of electronic services and attention is drawn to existing problematic issues in providing electronic services to residents living in rural areas, which requires further improvement of the legal mechanism for providing electronic services.
