ISSUANCE OF ADMINISTRATIVE ACTS AS A TOOL OF PUBLIC ADMINISTRATION OF NOTARIAL ACTIVITIES IN UKRAINE

Abstract

The article reveals scientific provisions based on doctrinal experience and analysis of empirical material concerning the issuance of administrative acts by specialized administrative bodies, as the most commonly used instrument of public administration. The legal nature of administrative acts in the field of notarial activities, their impact on the functioning of the notarial institution, and the features that characterize these acts as administrative-legal instruments are established. It is determined that administrative acts in the notarial field are an important means of ensuring public interests and harmonizing relations between administrative bodies, notaries, and other individuals. Examples of administrative acts are provided, including decisions on the suspension of notaries’ activities, the annulment of certifications of workplaces, or the conduct of inspections. The article emphasizes the need to comply with procedural and substantive norms when issuing administrative acts, as their legal force is crucial for ensuring legal certainty. Approaches to the classification of administrative acts by issuers, legal consequences, and form are outlined. The role of administrative acts as tools for implementing legal norms in notarial activities is defined, focusing on the specification of the rights and obligations of notaries and ensuring compliance with them. The analysis of judicial practice regarding the appeal of administrative acts in the notarial sphere highlights the prevalence of such disputes in the context of protecting the professional interests of notaries and compliance with legislative requirements. Based on the generalization of administrative acts, their categories, and judicial practice, the conclusion was made that administrative acts are an essential instrument of public administration in the notarial sphere. At the same time, their application often involved procedural violations, insufficient evidence, or exceeding powers.This emphasized the importance of adherence by administrative bodies to legislative norms, transparency of procedures, and the protection of the rights of those affected by such decisions. Judicial control remained a key administrative-legal mechanism for balancing state interests with the protection of notaries’ rights.
