LEGAL LIABILITY FOR VIOLATION OF AGRICULTURAL LEGISLATION

Abstract

The article is devoted to the scientific study of the concept of legal liability for violation of agrarian legislation. It is established that legal liability is defined as a type of social liability, the essence of which is the application of sanctions provided for by law to offenders (individuals and legal entities), which are provided for by law and are enforced by the state. In agrarian law, legal liability is a complex legal institution that encompasses a system of multi-branch norms that establish the types and procedure for applying measures for violation of agrarian legislation. Legal liability for agrarian offenses is divided into types by industry, namely, administrative, criminal, property, disciplinary, material. It is determined that legal liability for violation of agrarian legislation is a complex inter-branch institution that includes legal norms that establish the types and means, the procedure for applying measures for violations in agricultural production. Types and means of liability of violators of agrarian legislation are regulated by norms of various branches of law. They have an inter-branch or general legal scope, therefore they are actively used to protect law and order in the agrarian sector of the economy. It has been established that the basis for liability is a violation of the rules of conduct, that is, agrarian legal relations. That is, the presence of an illegal act and the presence of guilt in relation to the committed offense. In addition, the basis for applying legal liability for violation of the norms of agrarian law should be called a law enforcement act issued by the relevant authority (order, resolution, verdict, etc.). It has been determined that for committed offenses, the legislation provides for the following types of legal liability: disciplinary, material, property, administrative, criminal. It has been concluded that when applying legal liability, the subjects authorized to apply the norms of law face the task of resolving the issue of what type of legal liability should be imposed and whether this will allow achieving the goal for which it is applied to the offender.That is, when determining the types and measures of liability, many factors are taken into account, the main one of which is what kind of illegal act was committed.
